Drepturile constituţionale ale străinilor în România

  • Subiect: „The pa per begins with an analysis of the causes of the increasing necessity of creating a better legal framework of aliens'rights: the continuous and more complex process of movement of individuals and groups, for different reasons, migration that characterises not only the developed countries anymore, but the Eastern-European countries as well, formerly only a source of emigration. The paper continues with a review of terminology regarding the topic - the notion of'alien' (and its distinction from the other categories of natural persons, according with different criteria), the problem of citizenship, (i.e. multiple citizenship and stateless persons). The Romanian view upon these issues has a special reference. The types of legal treatment (regime) of aliens are meant as an introduction to the part concerning a possible (but not necessarily exhausrive) list of the fundamental rights of non-citizens, again with direct reference to the Romanian constitutional provisions. The paper gives particular consideration to several constitutional rights, such as: the right of residence and free movement within the Romanian territory, the right to work, the right to property, the freedon of assembly and the right of association, the freedom of consience and of expression, the right to education, the political rights and, finally, the right of asylum. The pa per ends with a few conclusions, that concern the lacks of the highly desired fu ture equality between na tionals and non-citizens: with regard to economic and sociak rights, political rights and the right to reside in a foreign country, but also with the hope that the a ttenuation of the aliens'regime will move from the sphere of intention to that of realisation, so that the notion of the individual human being will prevail over nationality.”
