Hotărnicia în Ţara Românească- determinări diplomatice şi juridice

  • Subiect: As an institution of the mediaeval economic and social system, the settling of boundaries went through permanent structure modifications in the course of its evolution. The author presents his points of view regarding: the historical moment when settling -of boundaries began - before the XVI-th Century; the reason - solving of conflicts, setting -of the boundaries of the community; the institutions wich bad the right to settle boundaries boyar commission, ruler or Iater local authorities, boyar divan, ruler; the juridical procedure; the typology of diplomatic form- defined in the XVIII-th Century; penalties-fines. The analysis of the text of the documents reveals that the juridical procedure for investigating boundary problems - which was transmitted in an oral form (Rom „cutuma") ,- was very early cristalized and had a laster evolution than the terminology and the diplomatic form. Territorial delimitation were especially made by indicating territorial limits than by using surface measures.
